If a fire starts on or spreads from a landowner’s property and causes loss, that landowner is presumed to have been negligent until they can prove otherwise. This legal presumption does not apply to a defendant who is a member of a fire protection association in the area where the fire occurred. If you are not a paid-up member of NEFSFPA, you are not protected by this provision. Please ensure your membership fees are paid immediately to maintain your legal protection under the Act and to support our vital fire prevention and firefighting efforts.
